Parts Warranty & Liability Disclaimer

Please carefully read and understand the following warranty and liability conditions before purchasing and installing any goods and services from G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level. By doing so, you agree to all the terms provided in this disclaimer.

All Genuine and third-party replacement parts come with a warranty of one (1) year or 100,000 miles from the installation date, whichever comes first, pending vendor authorization. This warranty covers defects in material or workmanship. However, it does not extend to parts that have failed or been damaged due to misapplication, accident, abuse, wear and tear, or acts of God.

To initiate a return for warranty, written authorization from G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level is required. If our examination determines that the parts are defective, we will replace them free of charge. Please note that this warranty only covers the replacement of defective parts and vendor-approved items. We do not assume liability for any parts, labor, shipping, or special or consequential damages of any kind.

If the parts return is authorized under this warranty, the buyer must wait for the settlement of their claim (vendor authorization) before any reimbursements or product exchanges can take place. Expenses incurred without our written consent will not be reimbursed.

If the failure is not due to an accident, damage, negligence, abuse/misuse, improper installation or maintenance, or any other conditions outlined in the Limits and Exclusions section of the supplier's Warranty Manual, G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level will consider the condition as covered under its warranty. However, please note that this determination does not necessarily indicate the existence of a defect. In all cases, G.A.P. Big Rig Power will make the final determination and interpretation regarding the warranty coverage of the product.

By using or misusing any parts or information received from G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level, you acknowledge and agree that G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level shall not be liable for any damages incurred. This includes, but is not limited to, direct, indirect, incidental, special, consequential, exemplary, compensatory, punitive, or monetary damages, such as personal injury, bodily injury, loss of profits, goodwill, data, fines imposed by provincial/Federal/state law, or any other losses.

Claims relating to this agreement or pertaining to the limitation of liability shall prevent recovery of monetary, direct, indirect, incidental, consequential, special, exemplary, or disciplinary damages, regardless of whether such claims are based on warranty, contract, or other grounds. G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level will not be held liable for the usage or inability to use the parts or service, unauthorized access to or alteration of data, statements, or conduct of any third party on the service, or any other matters relating to the service.

G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level, as the Seller, provide no express or implied warranties to the Buyer, except for the express warranty described above. G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level disclaim any implied warranties of merchantability for these goods or their fitness for any purpose.

G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level are not responsible for errors or omissions or for the results obtained from using the information displayed on our website. All information provided on the site is "as is," and G.A.P. BIG RIG POWER/authorized dealers and affiliates at any level do not guarantee the completeness, accuracy, or timeliness of the results obtained from using this information. You use the content at your own discretion and risk, without any expressed or implied guarantee or warranty, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
